Contract between property owner/property manager and Express Apartments D.O.O.
Your use of this website is subject to your irrevocable acceptance without modification of these terms of use (the 'Terms') and you agree to use this website in accordance with and subject to these Terms. The Terms as set out hereunder constitute the entire agreement between you and Express Apartments D.O.O ('expressapartments.com'). Failure to read these Terms does not release you from them. Should you not agree to the Terms as set out, do not continue accessing the website. By accessing any part of the expressapartments.com website, you consent to be bound by these Terms.
You declare that you are the owner or authorised manager of the property published by you or on your behalf on expressapartments.com, that you are of legal age to use this website and to create legally binding obligations for any liability you may incur as a result of the use of this website and that you understand that you are responsible for all users of this website by you and those using your log-in information.
You understand that all the necessary information regarding the publication of your property including photos and text description on expressapartments.com is done autonomously by you and that you’re responsible for that information to be accurate, precise and true. In the case of false, untrue and inaccurate information regarding your property you will suffer any legal and financial consequences that this might cause.
It is your responsibility to insert all the necessary information regarding the particular booking terms and conditions your property might have. You are obliged to promptly change or update any new information/description regarding your property on expressapartments.com as soon as any changes become apparent. You are to maintain your availability calendar and keep it updated and accurate. The information/description of your property on expressapartments.com MUST always be up to date no matter what the circumstances. In cases of unexpected, unpredictable and reasonable problems that might occur preventing you from updating any new information/description of your property, you are obliged to inform expressapartments.com immediately so that we may update that information for you. This can only be done in extreme and rare situations as it is not the responsibility of Express Apartments to upload your information.
You declare that the renting of your property is a legal activity in your local area and that you are renting it with the purpose of economical gain.
You declare that your property satisfies all legal requirements in your local area with respect to the standard of the property and any health and safety regulations of appliances and furniture provided by you inside the apartment being rented.
The booking has been made once you have received an e-mail from our bookings division informing you that the booking of your property is confirmed. This means that we have received an online payment from the clients that booked your property and that NO modifications/cancellations are possible once the client has received confirmation of this booking.
The service of publishing and online booking of your property on expressapartments.com is free of charge. However, you’re obliged to follow certain conditions regarding the booking of your property in case of confirmed bookings:
- 1. You are obliged to accept the booking of Expressapartments.com every time you receive a confirmed booking.
- 2. It is your duty to update the availability calendar on our website autonomously and with precision. We will not accept nor tolerate failure in doing so.
- 3. The apartment offered for the stay of the clients that made the booking on our website, needs to be exactly the same as described on expresspartments.com. It is your legal and financial responsibility to insert accurate, precise and true descriptions of your property.
- 4. It is your responsibility to offer the services to the client that made the booking of your property according to this contract and the term and conditions of Expressapartments.com.
- 5. You are obliged to offer all the services that your property offers during the stay of the clients and that you autonomously described as “service offered included in price”. You guarantee that those services will be offered and you understand that you will suffer legal and financial consequences if the services are not offered once the clients have reached the apartment according to the booking made on expressapartments.com. In case of temporary lack of certain services which are not due to your negligence nor fraudulence (for example - no internet service although described as an offered service – this could be due to technical problems in the building or city, or any other innocent interruption of the service) you MUST discuss this matter with the client directly prior to their arrival and check-in, informing them of this issue and of the circumstances that brought about the interruption. If you cannot solve the problem directly with the client, and you are sure of your “innocence” you are to email Express Apartments documentation regarding the temporary services interruption due to other unpredictable and temporary problems as proof. If the lack of service will continue for an extended amount of time, you MUST remove the information that you are providing this service from the website.
- 6. It is your responsibility to contact the client autonomously and arrange the check-in on the day of their arrival. In case you fail to contact the client, you must inform Expressapartments.com immediately. Our general terms and conditions provide that the rental begins from 14:00 CET on the day of arrival and ends at 10:00 CET on the day of departure. The check-in is done at any time after 14:00CET of the day of arrival and the check-out is done at any time before 10:00 CET of the day of departure without any supplementary costs.
It is your responsibility and duty to insert the correct information on our website. Should your check-in and check-out times differ from our general terms and conditions, and you have other supplementary charges for late arrivals and early departures, the client needs to be informed of such supplementary charges PRIOR to booking. It must be written clearly and visibly in the description area of your property on Expressapartments.com. The client has the right to refuse any payment that goes beyond what is specified in a description area of our website.
- 7. Your property needs to be clean and ready to accept the clients on the day of their arrival. It is your duty to provide the clients with clean linen and towels and that this be included in the booking price.
- 8. It is your duty to update regularly the price of your property on Expressapartments.com. After a booking has been confirmed it is your duty to accept it according to the price had you autonomously inserted on our website.
- 9. You MUST provide us precise/correct/accurate and true contact information of your property. You also need to advise the times you will be available for contact and provide an after-hours emergency contact number.
- 10. In case you property becomes unavailable due to extenuating circumstances, you need to inform Express Apartments immediately. It is your duty to provide an alternative solution of equal quality, structure and same city area at the same price as alternative accommodation for the client in case Express Apartments is unable to provide one of their own. You MUST inform the client PRIOR to their arrival of the situation, of your proposed solution and the opportunity to cancel at no additional cost.
- 11. Most clients come from different countries and have different cultures and dress codes. It is your duty to assist them and provide them with all the local legal information they may need, as well as all the necessary information regarding the usage of the appliances in your property.
- 12. It is your duty to take the amount of money as per booking from the clients on the day of their arrival or prior. Expressapartments.com is exempted of any responsibility in that sense. Expressapartments.com can NOT be held responsible for any no-show case of the clients or any other arrival problems clients might have. Unfortunately it is beyond our control to charge any penalty or fine to the clients in case of no show. Some property owners ask a 30% prepayment from the clients to protect themselves from situations such as these. It is to be arranged directly with the client after a booking has been made. However, our analysis shows that owners that ask a 30% prepayment directly from the clients, prior to their arrival usually receive less bookings then the property owners/managers that don’t. However, in case you decide to ask a 30% prepayment prior to arrival, it needs to be clearly outlined and visible in the description area on our website PRIOR to the client booking. Once the booking has been confirmed, you have a minimum of 7 days to get in touch with the client directly and ask for your 30% prepayment or for a written confirmation that the payment transaction has been completed. If after 7 days from receiving the booking you still have not receive the stated payment of 30%, the booking will be considered null.
Please note that the owners who give accurate information and update their website regularly have higher gain and generally less or no problems. Note also that competitive pricing is something that sells your property, so keep doing your research for what is reasonable for your area and what you are asking for your property.
